§ 6-152. Hours of sale generally.

  • (a)

    Except as otherwise provided in this article, alcoholic beverages shall be sold and delivered to the customer for consumption on the premises only during the following hours:

    (1)

    Monday through Saturday hours are from 9:00 a.m. until 2:00 a.m. the following day.

    (2)

    Sunday hours are from 12:30 p.m. until 11:59 p.m. as permitted by section 6-153.

    (3)

    Sales and deliveries during all other hours are prohibited. There shall be no consumption on the premises after prohibited hours have been in effect for 30 minutes. All licensed establishments must close their premises to the public and clear their premises of patrons by 2:30 a.m. Tuesday through Sunday and by 12:30 a.m. Monday. These times and rules also apply to the section or area of a grocery store in which sales for consumption on-premises occur.

    (4)

    Sunday sales - extended hours. Permitted hours of sale and operation for consumption on the premises locations shall be extended to match Monday through Saturday hours for establishments eligible for Sunday sales when the following days or events occur on a Sunday: New Year's Day; NFL's Super Bowl; March 17 (St. Patrick's Day); May 5 (Cinco de Mayo); the Sunday before Memorial Day holiday; July 4 (Independence Day); the Sunday before Labor Day holiday; and December 31 (New Year's Eve). This section does not allow Sunday sales at establishments unless they hold a Sunday sales license.

    (b)

    It shall be unlawful for an establishment that is licensed to sell alcoholic beverages for consumption on the premises to remain open to the public after 12:30 a.m. on any day that doing so is otherwise permitted under subsection (a), unless the establishment has filed a complete written safety plan that contains the information required by section 6-155.

    (c)

    When an establishment has filed a complete written safety plan, the city clerk shall include the following notation on the license: "This establishment has filed a complete written safety plan that contains the information required by section 6-155 of the Chamblee Code."
