§ 58-36. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Custodian means any person over the age of 21 years who is in loco parentis to a juvenile.

    Guardian means any person other than a parent who has legal guardianship of a minor.

    Minor means any person under the age of 18 years.

    Parent means the natural or adoptive parent of a minor.

    Public place means any street, alley, highway, sidewalk, park, playground or place to which the general public has access and a right to resort for business, entertainment or other lawful purpose. The term "public place" includes but is not limited to, any store, shop, restaurant, tavern, bowling alley, cafe, theater, drugstore, pool room, shopping center or other place devoted to amusement or entertainment of the general public. It also includes the front or immediate area of such places.
